Abstract(s)
Neste trabalho, iremos abordar a temática das wrongful life actions (ações de vida indevida) e o seu lugar no regime da responsabilidade civil do ordenamento jurídico português. Este tipo de ações – provindas da conjugação da evolução da ciência médica e da tecnologia (nomeadamente, no campo da medicina pré-natal) com a maior exigência por parte do paciente perante a prestação de serviço médico – envolve uma discussão onde o Direito e a Ética se parecem tocar e por tal motivo divide doutrina e jurisprudência um pouco por todo mundo. Este estudo começará com a apresentação das várias ações que compõe as denominadas wrongful actions, seguindo-se uma análise jurisprudencial sobre os casos mais marcantes no seio das wrongful life actions. Posteriormente, analisaremos este tipo de ações à luz das regras de responsabilidade civil do nosso código civil, procurando dar a nossa opinião sobre um tema tão complexo e que tanto tem dado que falar.
In this paper, we will address the topic of wrongful life actions and their place in the civil liability regime of the Portuguese legal system. This type of claim – result of the combination of the evolution of medical science and technology (notably in the field of prenatal medicine) and the increased number of patients demanding better medical services - involves a discussion where Law and Ethics seem to collide and for that reason it divides doctrine and jurisprudence around the world. This study will begin with the presentation of the various actions that make up the so-called wrongful actions, followed by a judge-made law analysis of the most striking cases within the wrongful life actions. Subsequently, we will analyze these actions under the Portuguese Civil Code rules on civil liability, trying to give our opinion on such a complex subject that has given so much to talk about.
