Abstract(s)
O abuso sexual de menores é um crime hediondo de consequências imediatas e a longo prazo, frequentemente de proporções catastróficas e irreversíveis. Lamentavelmente, a grande maioria destes crimes são praticados por alguém próximo da criança.
A presente dissertação visa demonstrar o crescente reconhecimento da criança no plano jurídico como sujeito de direitos e, outrossim, evidenciar o seu superior interesse como princípio base de todas as decisões judiciais que envolvam menores.
Ademais, pretende-se analisar o conteúdo das responsabilidades parentais como conjunto de poderes-deveres/poderes-funcionais que são atribuídos pela ordem jurídica aos progenitores no interesse dos filhos.
Será desse estudo que se procederá à análise do crime de abuso sexual de crianças e as suas consequências legais nos processos de regulação das responsabilidades parentais.
No âmbito desta dissertação propõe-se, também, destacar a correlação entre o processo crime e o processo tutelar cível enquanto processos distintos e com objetivos diferentes.
Sexual abuse of minors is a physical and an emotional crime against children of enormous, immediate and long-lasting consequences, often of irrecuperable proportions. Yet, these crimes are, frequently, committed by those supposed to protect and defend them - parents or their close acquaintances. This dissertation sets out to demonstrate the increasing recognition of the rights of the Child in the legal framework and, at the same time, to illustrate the supreme importance of the child’s superior interest as the foundation for all judicial decisions involving minors. Analysis is also undertaken to the extent of parental responsibilities as a series of rights- responsibilities/functional-rights, attributed by law to the parents in the interest of the children. This study goes on to consider the crime of sexual abuse of children and looks at the legal consequences in parental responsibility regulatory processes. Given the differing objectives, a correlation is drawn between the independent criminal and civil processes.
