Abstract(s)
Os crimes praticados em função da cultura são de diversas espécies. Aqui se incluem crimes como a mutilação genital feminina, homicídios por motivo de honra, casamento através do rapto, abate ritual de animais, entre outros. Este estudo irá analisar estes e outros crimes e pretende compreender qual a solução que deve ser adotada aquando da determinação da responsabilidade dos agentes do crime e qual a dicotomia existente entre a nossa sociedade ocidental e as sociedades com diferentes valores culturais. A identidade pessoal está intrinsecamente ligada à identidade cultural de cada um. Todavia, apesar da cultura condicionar as escolhas dos indivíduos, não as esgota. A integração e o diálogo com diferentes culturas possibilitam uma maior abertura de mentalidades e diminuem o número de crimes culturalmente motivados. Visamos com este trabalho demonstrar qual o impacto que a motivação criminal pode ter num indivíduo e como as vítimas do crime podem ser protegidas devidamente.
Culturally motivated crimes are of various kinds. These include crimes such as female genital mutilation, honour killings, marriage by kidnapping, ritual slaughter of animals, among others. This study will analyse these and other crimes and intends to understand what solution should be adopted when determining the responsibility of the perpetrators and what dichotomy exists between our Western society and societies with different cultural values. Personal identity is intrinsically linked to one's cultural identity. However, despite the fact that culture can shape choices of individuals, it doesn't exhaust them. Integration and dialogue with different cultures make it possible to open up mentalities and reduce the number of culturally motivated crimes. With this work we aim to demonstrate the impact that cultural motivation can have on an individual and how victims of crime can be properly protected.
