Abstract(s)
A presente dissertação visa examinar a Convenção nº 190 da OIT sobre a eliminação da violência e do assédio no mundo do trabalho, assim como a Recomendação nº 206 que a acompanha, refletindo sincronicamente sobre as respostas existentes no quadro normativo nacional. Cientes da miríade de temas contemplados pela Convenção, a nossa análise centrar-se-á, num primeiro momento, nas amplas e inovadoras definições de “violência e assédio” e de “violência e assédio com base no género” e nas dúvidas interpretativas que estas têm suscitado. De seguida, debruçar-nos-emos sobre o seu âmbito de aplicação na sua vertente subjetiva, espacial e temporal, assumindo particular destaque a inclusão das TIC no elenco apresentado. Finalmente, dedicamos especial atenção à tutela do trabalhador vítima de violência e assédio, mormente à proteção conferida ao trabalhador vítima de violência doméstica, dedicando-nos, por último, ao estudo dos mecanismos de denúncia à luz da proteção do whistleblower e à reflexão sobre as vias de reparação ao seu dispor.
This dissertation aims to examine ILO Convention No. 190 on the elimination of violence and harassment in the world of work, as well as the accompanying Recommendation No. 206, reflecting synchronically on the existing responses in the national legal framework. Aware of the myriad of issues covered by the Convention, our analysis will first focus on the broad and innovative definitions of “violence and harassment” and “gender-based violence and harassment” and the interpretative doubts they have raised. Then, we will look at their subjective, spatial and temporal scope of application, with particular emphasis on the inclusion of ICT in the presented framework. Finally, we will pay special attention to the protection of workers who are victims of violence and harassment, particularly the protection granted to workers who are victims of domestic violence, and lastly we will study the mechanisms of reporting in the light of whistleblower protection and reflect on the remedies available of redress.
