| dc.description.abstract | O processo de inventário foi alvo, na última década, de sucessivas e diversas abordagens e reformas que visavam assumidamente o descongestionamento dos tribunais, mas essencialmente reduzir as pendências e melhorar os resultados de natureza estatística que demonstravam serem as ações de inventário, em média, aquelas que mais tempo demoravam a transitar em julgado. A opção consagrada em 2009, que atribuía competência para o processamento do processo de inventário aos cartórios notariais revelou-se inadequada, pelo que, em 2019, o novo regime do processo de inventário judicial foi inserido no Código de Processo Civil, embora continue a existir a possibilidade residual do inventário notarial. O presente estudo pretende ressaltar as alterações mais substanciais operadas no processo de inventário e as suas funções. | pt_PT |
| dc.description.abstract | The inventory process has been the target, in the last decade, of successive and diverse approaches and reforms that admittedly aimed at decongesting the courts, but essentially reducing the pending issues and improving the results of a statistical nature that demonstrated that the inventory actions, on average, were those that took longer to become final. The option established in 2009, which attributed competence to process the inventory process to notary offices, proved to be inadequate, so in 2019, the new regime for the judicial inventory process was inserted in the Civil Procedure Code, although it still exists the residual possibility of the notary inventory. The present study aims to highlight the most substantial changes made in the inventory process and their functions. | pt_PT |
