Abstract(s)
O tema do presente trabalho relaciona-se com a aplicação do instituto da suspensão provisória do processo no crime de violência doméstica. Mais do que uma simples abordagem ao instituto em causa, visa-se criticar a sua aplicação no fenómeno criminal da violência doméstica, indicando soluções de combate e prevenção deste fenómeno. Tendo em conta esta finalidade, analisaremos os perigos associados ao recurso a esta figura legal, com especial destaque para a situação da vítima. Conclui-se que é necessário haver uma alteração legislativa que proíba a aplicação deste instituto nos casos de violência doméstica, sublinhando o seu carácter de especialidade jurídica e social.
This present work relates the application of the institute of provisional suspension of the process in the domestic violence crime. More than a simple approach to the institute in question, its aim is to criticize its application in the criminal phenomenon of domestic violence, indicating solutions to combat and prevent it. Regarding this, we will analyze the dangers associated with the use of this legal figure, with particular emphasis on the victim situation. As concluding remarks there is the need for a legislative change regarding the presuppositions of the application of this institute in cases of domestic violence, underlining its legal and social specialization.
