A presente dissertação versa sobre uma temática de bastante pertinência: a
Resolução em Beneficio da Massa Insolvente. Pretende-se uma análise geral do regime, tanto da resolução condicional como incondicional, com uma linha de profundidade alargada relativamente a esta ultima e, forçosamente, às diversas alíneas do art 121º do CIRE. Versaremos sobre a análise comparativa face ao regime do CPEREF, concretizando as alterações essências. Cumpre-nos, também, uma referência aos meios gerais de conservação da garantia patrimonial, de entre os quais se destaca a Impugnação Pauliana, instituto que ao longo deste estudo será comparado ao da Resolução em Benefício da massa insolvente, o que permitirá concluir, desde logo, pela acentuada inovação do atual regime com principal destaque para a exclusão do instituto da Impugnação Pauliana Coletiva.
The present dissertation is about a subject of great pertinence: the Resolution to the Benefit of the Insolvent State. I intend to do a general analysis of the regime, both conditional and unconditional, with an extended depth line concerning this last one and, forcibly, to the various items of CIRE art 121. We will go on with a comparative analysis face the CPEREF regime, concretizing the essential changes. We also have a reference to the general means of preserving the equity guarantee, among which we highlight the Pauline Impugnation, an institute that throughout this study will be compared to the Resolution in Benefit of the Insolvent State, which will allow us to immediately conclude, by the accentuated innovation of the current regime, with the main highlight being the exclusion of the institute of Collective Pauline Impugnation.
