| dc.description.abstract | A presente dissertação tem como objetivo analisar a problemática do abuso sexual de menores, dissecando sobre os pontos mais problemáticos deste tipo de ilícito. Sendo o abuso sexual de menores uma das formas mais graves de maus-tratos infantis, é importante assegurar o direito de todas as crianças a uma infância digna, protegendo o processo de desenvolvimento pessoal da criança para que decorra de forma natural e sem influências perturbadoras ou traumatizantes para o menor. A reforma de 1995 do Código Penal foi um ponto chave para a proteção das vítimas dos abusos sexuais. Com a revisão do Código Penal de 1995, os crimes sexuais deixaram de ser vistos como crimes contra a coletividade e contra a honra da sociedade, chegou-se à conclusão de que o crime de abuso sexual de crianças protege bens jurídicos individuais, a liberdade sexual dos menores, dentro da qual se incluí a autodeterminação sexual. A liberdade sexual do menor é tutelada pelo Direito Penal, quando sanciona os atos sexuais praticados com a vítima, quando esta manifeste uma vontade viciada, porque condicionada por fatores externos de relevo e não controláveis pela mesma, que lhe são impostos por um terceiro que se encontra numa posição de autoridade ou temeridade face à vítima. Esta dissertação serviu também para fazer uma análise quanto ao consentimento do menor. Até aos catorze anos, a proteção da vertente negativa da liberdade sexual do menor é tendencialmente absoluta. No entanto, nem todas as condutas sexuais praticadas com ou em menores constituem um crime. Por isso, é fundamental a promoção da vertente positiva da liberdade sexual, não sendo defensável a tese da castidade absoluta do menor de catorze anos. | pt_PT |
| dc.description.abstract | The present dissertation aims to analyse the problematic of child sexual abuse, dissecting the most problematic points of this type of illicit act. The child sexual abuse is one of the most serious forms of child maltreatment, therefore it is important to ensure the right of all children to a dignified childhood, protecting the child's personal development process so that it takes place in a natural way and without disturbing or traumatizing influences for the minor. The 1995 reform of the Penal Code was a key point for the protection of victims of sexual abuse. With the revision of the Criminal Code in 1995, sexual crimes were no longer seen as crimes against the collectivity and against the honor of society, the conclusion was reached that the crime of sexual abuse of children protects individual legal goods, the sexual freedom of minors, within which sexual self-determination is included. This dissertation also served to make an analysis regarding the minor's consent. Until the age of fourteen, the protection of the negative aspect of the sexual freedom of minors tends to be absolute. However, not every sexual conduct practiced with or on minors constitutes a crime. Consequently, the promotion of the positive side of sexual freedom is fundamental and the thesis of absolute chastity of the under fourteen year old is not defensible. | pt_PT |
