Abstract(s)
A presente dissertação pretende promover a reflexão crítica sobre um dos temas mais complexos do Direito Penal: os limites à incriminação da pornografia de menores. Primeiro, relembramos todos os conceitos inerentes às finalidades da intervenção penal, desde a noção de bem jurídico à relação entre política-criminal e Constituição. Depois, procedemos a uma evolução histórica da legislação em matéria de criminalidade sexual, uma vez que aqui se deram as mais importantes transformações a respeito do bem jurídico objeto de tutela. Uma vez compreendido o enquadramento atual, analisamos o crime de pornografia de menores. Trataremos o conceito de pornografia infantil e as controvérsias geradas por algumas das condutas típicas. Por fim, dedicamos uma especial atenção à pseudopedopornografia, onde se questiona um possível retorno à moral sexual e os eventuais conflitos com outros direitos fundamentais.
The following thesis aims to promote the critical reflection on one of the most intricate subjects of Criminal Law: child pornography and the limits of its incrimination. First, we recollect all the concepts inherent to the ends of criminal intervention, such as juridical asset and the connection between criminal politics and Constitution. Then, we proceed to the historical evolution of sex crimes legislation, since important transformations occurred concerning the juridical asset. Once the current framework is understood, we move on to the analysis of child pornography. We shall see the definition of child pornography and the controversies regarding some of the conducts. Finally, we pay a special attention to pseudopedopornography, where we question the eventual return to the sexual moral and potential conflicts with other fundamental rights.
