A lei portuguesa reserva uma quota aos designados legitimários, pelo que, sendo a quota disponível ultrapassada, o direito à legítima irá prevalecer, podendo os herdeiros legitimários recorrer ao instituto da redução das liberalidades (art. 2168º e ss) para obter a ineficácia de tais liberalidades e a restituição do seu valor, assim assegurando o preenchimento da legítima. O presente estudo aborda o modo como a sucessão legitimária limita a autonomia do autor da sucessão e os inconvenientes gerados por este mecanismo de proteção da legítima. Inspirando-se nas soluções de alguns ordenamentos europeus que consagram institutos similares à legítima sugerem-se alterações que menorizem a situação de insegurança dos donatários.
Portuguese law reserves a portion for the so-called forced heirs, so if the available portion is exceeded, the right to the forced heirship will prevail, and the forced heirs can resort to the institute of the abatement of dispositions (article 2168 et seq.) to obtain the ineffectiveness of such disposition and the restitution of its value, thus ensuring the fulfilment of the forced heirship. This study deals with the way in which the forced heirship succession limits the autonomy of the author of the succession and the inconveniences by this forced inheritance protection mechanism. Inspired by the solutions of some European legal systems that have similar institutes to forced heirship, changes are suggested to reduce the situation of insecurity of the donees.
