Abstract(s)
A solidariedade entre gerações é uma função essencial da Família. Os laços de cooperação e entreajuda devem orientar a atuação familiar, mormente perante a existência de um membro com especiais necessidades. Neste trabalho, pretende-se refletir sobre o alcance do direito-dever de assistência no caso do filho/a com deficiência, estruturando-se a investigação de acordo com um critério temporal. A análise será dividida em três etapas: a menoridade, o intervalo etário entre os 18 e os 25 anos e, por fim, o período subsequente a essa idade. Respaldados nos objetivos da autonomia e inclusão consagrados pela Convenção sobre os Direitos das Pessoas com Deficiência, propomo-nos a ensaiar soluções para, em cada fase da vida do filho/a carecido de apoio, melhor entender o direito-dever de assistência e as suas eventuais especificidades. Conclui-se a enunciada dissertação com um breve excurso em torno das respostas oferecidas por outros ordenamentos jurídicos, avançando com alguns contributos para a reflexão crítica do alcance do referido direito-dever, no caso em que o filho/a reclame um maior dispêndio de meios de apoio e, porventura, exija um prolongamento do tempo necessário para alcançar a independência.
Solidarity between generations is an essential function of the Family. Bonds of cooperation and mutual help must guide family dynamics, especially when a member has special needs. This study aims to reflect on the scope of the right-duty of support in the case of a child with disabilities, structuring the investigation according to a temporal criterion. The analysis will be divided into three stages: minority, the age range between 18 and 25 and, finally, the period after that age. Anchored in the objectives of autonomy and inclusion enshrined in the Convention on the Rights of Persons with Disabilities, we set out to test solutions so that, at each stage of the life of the child in need of support, we can better understand the right-duty of support and its possible specificities. The dissertation concludes with a brief overview of the responses offered by other legal systems, with some contributions to critical reflection on the scope of this right-duty in cases where the child requires a greater outlay of means of support and perhaps requires an extension of the time needed to achieve independence.
