Os novos contornos da criminalidade moderna reacenderam o atual debate sobre a legitimidade do uso da tortura em situações excecionais. Numa frente moderada, reafirmando o carácter absoluto da proibição de tortura na ordem internacional, e não podendo desatender a todo o desvalor ético associado a esta conduta após épocas de abuso e instrumentalização probatória sistemática, pretendese, neste estudo, compatibilizar o núcleo essencial dos direitos fundamentais com os desafios securitários do sec. XXImuitas vezes apresentados sob o paradigma de casos bombarelógio. Enraizando, desta vez, o debate em causas de desculpa, procurase, aqui, aferir, à luz de que instrumentos seria inteligível a não responsabilização do agente pela prática de atos de tortura em situaçõeslimite quando não lhe seja exigível adotar outra conduta.
The new profile of modern criminality has reignited the ongoing debate on the legitimacy of the use of torture in exceptional situations. On a moderate front, reaffirming the absolute nature of the prohibition of torture in the international order, and not being able to disregard all the ethical devalue associated with this conduct after times of abuse and systematic evidentiary instrumentalization, in this study, it is aimed to reconcile the essential core of fundamental rights with the security challenges of the 21st century often presented under the paradigm of ticking time bomb scenarios. This time, focusing the debate in causes of excuse, it was intended, here, to assess, in the light of which instruments it would be intelligible not to blame the agent for the practice of acts of torture in limit situations when he is not required to adopt an alternative conduct.
