O terrorismo constitui uma das formas mais atrozes e desumanas de ofender e colocar em causa a paz entre a comunidade internacional. Não obstante da diversa regulamentação interna de cada Estado quanto ao crime, certo é que não está definido internacionalmente. Consensual é, porém, que constitui bárbaras condutas que aterrorizam toda a humanidade, constituindo um perigo e uma preocupação mundiais. Atualmente o terrorismo poderá revestir a mais variada trama, acompanhada de uma incomensurável astúcia e sagacidade, sendo um fenómeno em constante e retorcida evolução que não pode em qualquer circunstância ficar impune. Ao invés de se perpetuar a discussão infinita sobre as delimitações dos conceitos, tendo em conta os vários entendimentos e conclusões obtidas, decisões já tomadas e experiência de vida, convida se agora a uma análise sobre os pressupostos e veja-se como este fenómeno tão bem pode cair nos crimes contra a humanidade, além da simples e primeira semelhança, da dimensão e gravidade dos eventos. Note-se que assim o Tribunal Penal Internacional poderá julgar os agentes destes atentados, punindo e responsabilizando no plano internacional, melhor dando cumprimento ao objeto e finalidade do ETPI, bem como à promoção da confiança, segurança e bem-estar da comunidade internacional.
Terrorism is one of the most atrocious and inhumane forms of offending and jeopardizing peace within the international community. Despite the different internal regulations of each State regarding this crime, it’s certain that it’s not defined internationally. However, it’s consensual that it constitutes barbaric conducts that terrifies all humanity, constituting a danger and a worldwide concern. Currently terrorism can take on the most varied plot, accompanied by an immeasurable cunning and sagacity, being a phenomenon in constant twisted evolution that cannot, under any circumstances, go unpunished. Instead of perpetuating the discussion about the delimitations of the concepts, considering the various understandings and conclusions obtained, decisions already taken and life experience, you’re now invited to an analysis of the assumptions and see how this phenomenon may falls so well in crimes against humanity, beyond the simple and first similarity, the dimension and gravity of events. It should be noted that by this way the International Criminal Court will be able to judge the agents of these attacks, punishing and holding accountable at an international level, better complying with the security and confidence of the international community.
