Abstract(s)
A presente dissertação propõe-se a analisar o abuso sexual de crianças intrafamiliar, uma transgressão de gravidade acrescida, marcada pelo silêncio das vítimas e pela violação do dever de garante inerente às relações familiares, a partir de uma abordagem sociojurídica. Para tal, analisaram-se três casos jurisprudenciais e realizaram-se entrevistas a magistradas. Dada a prevalência estatística destes crimes, o estudo procura contribuir para uma compreensão aprofundada desta realidade, através da discussão das suas características e problematização acerca do enquadramento jurídico. A tese é composta por três capítulos: o primeiro sobre o conceito legal de criança e família, com ênfase na caracterização do abuso sexual intrafamiliar, suas agravantes e penas acessórias; no segundo capítulo exploram-se os tipos legais que formam os crimes sexuais contra crianças, incluindo uma incursão histórica acerca do bem jurídico tutelado e uma análise das suas condutas típicas. No terceiro capítulo, procede-se a uma análise crítica de decisões judiciais, em particular quanto à qualificação dos factos no crime de abuso sexual de crianças ou no crime de violação ou coação sexual agravado. Adicionalmente, apresenta-se uma abordagem exploratória às perceções da magistratura acerca deste ilícito e da sua problemática.
This dissertation aims to analyze the intrafamilial sexual abuse of children, a transgression of increased severity, marked by the silence of victims and the violation of the duty of care inherent in family relationships, from a social-legal perspective. To this end, three jurisprudential cases were analyzed, and interviews were conducted with magistrates. Given the statistical prevalence of these crimes, this study seeks to contribute to a deeper understanding of this reality by discussing its characteristics and problematizing the legal framework. The thesis is composed of three chapters: the first focuses on the legal concept of child and family, emphasizing the characterization of intrafamilial sexual abuse, its aggravating factors and accessory penalties; the second chapter explores the legal norms that constitute sexual crimes against children, including a historical overview of the protected legal interest and an analysis of their typical conduct. In the third chapter, a critical analysis of judicial decisions is conducted, particularly regarding the qualification of facts in the crime of child sexual abuse or in the crime of aggravated rape, or sexual coercion. Additionally, an exploratory approach is presented regarding the perceptions of the judiciary about this offense and its issue.
