| dc.description.abstract | A presente dissertação pretende realizar uma análise crítica do crime de extreme pornography, especificamente na vertente de rape pornography, consagrado no ordenamento jurídico do Reino Unido, de forma a equacionar a possível transposição do tipo legal para a ordem jurídica portuguesa. Consequentemente, iremos observar a génese da ofensa, tendo em conta o contexto social e político em que surgiu, procedendo à dissecação da Secção 63 do Criminal Justice and Immigration ACT de 2008 de forma a estudar os elementos que a constituem. Posteriormente, iremos afunilar o nosso estudo, focando-nos no crime de rape pornography, analisando o bem jurídico que visa tutelar e as críticas que lhe foram tecidas aquando da sua criação e aplicação. Uma vez compreendido o enquadramento jurídico do crime, iremos focar a nossa atenção no ordenamento jurídico português relembrando os conceitos inerentes às finalidades da intervenção penal, nomeadamente o papel do bem jurídico no processo de criação de um novo tipo fundamental de crime. Por fim, iremos oferecer possíveis propostas para a introdução do crime de pornografia de violação na nossa ordem jurídica, analisando algumas das críticas que lhes podem ser apontadas. | pt_PT |
| dc.description.abstract | The present dissertation intends to perform a critical analysis of the extreme pornography crime, specifically rape pornography, consecrated in the United Kingdom legal system, in order to consider its possible transposition to the Portuguese legal system. Consequently, we will observe the genesis of the offence, taking into account the social and political context in which it arose, dissecting section 63 of the Criminal Justice and Immigration ACT 2008 in order to study the elements that constitute it. 9 Afterwards, we will narrow down our study, focusing on the crime of rape pornography, analyzing the juridical asset it aims to protect and the criticisms that have been made when it was created and applied. Once the legal framework of the offence is understood, we will focus our attention on the Portuguese legal system, recalling the concepts inherent to the purposes of penal intervention, namely the role of the juridical asset in the process of creation of a new type of crime. Finally, we will evaluate possible proposals for the introduction of the crime of rape pornography in our juridical order, weaving some of the criticisms that may arise. | pt_PT |
