Os administradores são os principais afetados pelos efeitos que decorrem da declaração de insolvência da sociedade. Assim, a presente dissertação tem como objetivo analisar as obrigações, os deveres e as restrições que ocorrem, na pendência do processo de insolvência, na esfera jurídica e pessoal dos elementos que compõe o órgão de administração da sociedade insolvente. Neste sentido, vamos abordar estes temas à luz da legislação nacional, recorrendo à jurisprudência e doutrina, bem como ao direito comparado.
Directors are the ones affected by the consequences that result from the declaration of insolvency of the society. Therefore, this dissertation aims to analyze the obligations, duties and restrictions that occur, during the insolvency process, in the legal and personal sphere of the elements of the administration body of the insolvent company. In this regard, we will address these issues in the light of national legislation, invoking jurisprudence and doctrine, as well as comparative law.
