A presente dissertação avalia a interseção entre a punição e o princípio da dignidade da pessoa humana, com especial foco na pena de prisão e nas condições do sistema prisional português. Inicia-se a investigação com uma abordagem etimológica e histórica do conceito da pena de prisão, avançando para a discussão das teorias da prevenção geral e especial. Ainda que a legislação penal, nomeadamente o artigo 40.º do CP, defenda a reintegração social como um dos objetivos fundamentais da pena, a taxa de reincidência e a persistência de condições indignas nos estabelecimentos prisionais revelam uma dissonância entre o ideal normativo e a realidade. Propõe-se uma reforma da política penitenciária, através do reforço das medidas não privativas da liberdade, investimento em condições dignas nos estabelecimentos prisionais, visando alcançar um sistema cumpridor das finalidades preventivas da pena, sem comprometer a dignidade da pessoa humana.
This dissertation assesses the intersection between punishment and the principle of human dignity, with a special focus on prison sentences and the conditions of the Portuguese prison system. The research begins with an etymological and historical approach to the concept of prison sentences, moving on to a discussion of general and special prevention theories. Although criminal legislation, namely Article 40 of the Penal Code, advocates social reintegration as one of the fundamental objectives of punishment, recidivism rates and the persistence of undignified conditions in prisons reveal a dissonance between the normative ideal and reality. A reform of prison policy is proposed, through the reinforcement of non-custodial measures and investment in dignified conditions in prisons, aiming to achieve a system that complies with the preventive purposes of punishment, without compromising human dignity.
