| dc.description.abstract | A abordagem que o presente estudo visa efetivar prende-se com a apreciação do impacto que o circunstancialismo atinente às Ofertas Públicas de Aquisição, mormente as obrigatórias, é capaz de projetar nas esferas jurídicas dos acionistas minoritários. O elemento norteador que acompanhou a reflexão desenvolvida consistiu em indagar se a imposição de uma oferta aquisitiva constitui, in veredicto, uma medida suficientemente capaz de proteção destes investidores ou, por outro lado, se a coexistência de diferentes interesses a serem acautelados no mercado mobiliário traduz um obstáculo intra-sistémico às necessidades tutelares em causa. | por |
| dc.description.abstract | The present study seeks to examine the impact that the circumstances surrounding Public Takeover Bids, particularly mandatory ones, may have on the legal positions of minority shareholders. The guiding question underpinning this analysis is whether the imposition of a takeover bid constitutes, in effect, a sufficiently robust protective mechanism for such investors or, conversely, whether the coexistence of competing interests within the capital market operates as an intra-systemic obstacle to the fulfillment of the relevant protective objectives. | eng |
