| dc.description.abstract | A presente dissertação tem por objeto a análise da possibilidade de se aplicar à arbitragem a figura da inversão do contencioso, introduzida no processo civil, em 2013, no artigo 369.º do Código de Processo Civil, levando em linha de conta a Lei de Arbitragem Voluntária e dois regulamentos, a saber, o da Câmara de Comércio Internacional e do Centro de Arbitragem Comercial. Esta questão central da eventual aplicabilidade à arbitragem da figura da inversão do contencioso surgiu-nos em razão da completa omissão legislativa, ou seja, em virtude de em nenhuma das fontes legais supra mencionadas se fazer menção expressa à possibilidade de a medida cautelar compor de forma definitiva o litígio. Desta indagação por sua vez derivam outras tais como: Existe uma lacuna? Poderá uma das partes requerer aos árbitros a inversão do contencioso? | dc.description.abstract | The present dissertation has the purpose to analyze the possibility and feasibility of applying to arbitration the inversion of litigation, that was introduced in the civil procedure in 2013 in the article 369 of the Civil Procedure Code, considering for this effect the Voluntary Arbitration Law and two regulations of the International Chamber of Commerce and the Center for Commercial Arbitration. The question of whether the inversion of litigation can be applied in arbitration arose due to a complete legislative omission. Not once, in the aforementioned legal sources, is expressed the possibility of interim measures composing definitely the litigation. From this question in turn others derive such as: Is there a legislative omission? Can one of the parties request the arbitrators to reverse the dispute?
