Abstract(s)
Considerando a adesão da União Europeia à Convenção Europeia dos Direito do Homem um dos temas clássicos no Direito da União Europeia e em virtude da recente alteração que o Tratado de Lisboa provocou no âmbito dos direitos fundamentais, tornou-se de novo pertinente revisitar o tema. Este estudo pretende, assim, e à luz do relatório final do CDDH que propõe o acordo de adesão, apreciar a proposta do mecanismo do prior involvement introduzido e que tem como função articular as relações inter-tribunais.
Bearing in mind the accession of the European Union to the European Convention on Human Rights is one of the classic themes in the European Union law and by virtue of the recent amendment to the Lisbon Treaty brought under the fundamental rights, it became of the utmost importance to revisit this topic. This study aims, thus, and in the light of the final report of the CDDH proposing the accession agreement, to consider the proposal of the prior involvement mechanism introduced here which has the main function of articulate the inter- courts relationships.
