dc.description.abstractCom o objetivo de tornar os seus mercados mais competitivos, os Governos procuram adotar medidas que incentivem a fixação de empresas no seu território, nomeadamente através da concessão de benefícios fiscais, instrumentos que, consoante o seu propósito, resultam normalmente numa redução do imposto a pagar por aquela entidade. No entanto, por vezes, quando ocorrem acontecimentos extraordinários, a legislação muda e os empresários poderão enfrentar mudanças que não só não os beneficiam, como os afetam negativamente, quebrando a sua confiança na estabilidade do ordenamento jurídico e no cumprimento das medidas que este garantiu. É esta a realidade por detrás da criação e consequentes modificações do art.92º do CIRC, artigo este sobre o qual nos debruçaremos. Este artigo restringe de forma indiscriminada todos os benefícios fiscais a um limite de 10%, apenas enumerando algumas exceções que, pela sua natureza, escapam do seu escopo. Analisaremos decisões jurisprudenciais que exploraram esta temática e que criaram uma linha de interpretação clara e orientadora para o futuro, garantindo desta maneira uma base firme e de segurança para os contribuintes.por
dc.description.abstractWith the aim of making their markets more competitive, governments seek to adopt measures that encourage companies to establish themselves in their territory, namely through the granting of tax benefits, instruments which, depending on their purpose, usually result in a reduction in the tax payable by that entity. However, sometimes, when extraordinary events occur, legislation changes and entrepreneurs may face changes that not only do not benefit them, but also affect them negatively, undermining their confidence in the stability of the legal system and compliance with the measures it has guaranteed. This is the reality behind the creation and subsequent amendments to Article 92 of the CIRC, an article we will focus on. This article indiscriminately restricts all tax benefits to a limit of 10%, listing only a few exceptions which, by their nature, fall outside its scope. We will analyze case law decisions that have explored this issue and created a clear and guiding line of interpretation for the future, thus ensuring a firm and secure basis for taxpayers.eng
