Abstract(s)
Este estudo consiste na análise da evolução do alojamento local (AL) numa situação de pré e pós pandemia da COVID-19. Em 2008, o legislador, desconhecendo o impacto que esta figura teria no nosso ordenamento jurídico, enquadrou-a no regime dos empreendimentos turísticos, atribuindo-lhe um carácter residual. Contudo, a procura por este tipo de exploração turística levou a que o AL passasse, em 2014, a ser uma categoria autónoma e consistente, surgindo o Regime Jurídico de Exploração de Estabelecimentos de Alojamento Local. Neste estudo dissertamos sobre o procedimento inerente ao exercício desta atividade, em que é necessário averiguar, além de outros requisitos, a idoneidade do edifício, o que poderá exigir a articulação deste procedimento com os procedimentos urbanísticos, designadamente os atinentes à utilização dos mesmos. Após esta análise avançamos até ao ano de 2020, ano em que o mundo foi fortemente abalado por uma pandemia provocada pelo vírus SARS-CoV-2, impedindo a circulação de turistas quer nacionais, quer estrangeiros. Esta pandemia trouxe consigo, além de uma criação efusiva de leis, um conjunto de medidas de apoio à habitação, uma vez que esta havia sido colocada em segundo plano nos centros históricos devido à massiva ocupação turística. Medidas que passam pela prorrogação do pagamento das rendas em contratos com e sem fins habitacionais, reconversão do AL em arredamento de longa duração e ainda a refuncionalização dos edifícios do AL em residências universitárias ou em estruturas de residências para idosos. Fazemos esta abordagem, procurando dar soluções aos problemas evidenciados na área da habitação e na refuncionalização de edifícios.
The aim of this study is to analyze goes through the analysis of the evolution of local lodging (in portuguese- Alojamento Local [AL]) before and after COVID-19 pandemic. In 2008, unknowing of the impact that this figure would have in our legal ordering, the legislator placed it under the touristic building framework, giving it a residual character. However, the search for this type of tourist accommodations originated a shift and, in 2014, AL was categorized as an autonomous and consistent class and the “Regime Jurídico de Exploração de Estabelecimentos de Alojamento Local” was established. In this study we dissert over the procedure to exercise this activity and the, in which it is necessaity to verify the suitability of the building, in order to obtain the authorization. Furthermore, we will analyze situations in which such authorizations foresee different uses, from commercial to housing, as well as the required construction works. After such analysis, we fast forward to the year of 2020 when the world was heavily shaken by a pandemic caused by the virus SARS-CoV-2, deterring, from both nationals and foreigners. This outbreak originated an effusive creation of laws along with a set of housing supporting measures, in light of the lack of attention given to this matter in the historic centers, due to the massive touristic occupation. Measures that include the extension of rent payments in contracts with and without housing purposes, the conversion of AL in long term housing and also the repurposing of AL buildings to university housings’ or elderly housing facilities. We go through this matter until today’s reality, in an attempt to provide solutions to the highlighted problems regarding housing and the repurposing of buildings.
