A presente dissertação de mestrado surge com o objetivo de refletir sobre a proteção legal conferida à parentalidade no nosso ordenamento jurídico e de que forma se tutelam situações específicas de grande impacto na conciliação entre a vida pessoal e profissional, em particular a tutela do trabalhador progenitor de nado-morto e a do nado-vivo que faleça após o parto, fazendo-o em contraposição com os regimes de outros ordenamentos jurídicos. Neste ensejo, procuraremos enfatizar os temas conexos, que têm sido recentemente reavivados, sobre o luto parental e o reconhecimento do luto na perda gestacional involuntária, tendo sempre em mente uma perspetiva crítica e analítica dos direitos atualmente concedidos.
This master's thesis arises with the aim of reflecting on the legal protection conferred to parenting in our legal system and how specific situations of great impact on the reconciliation of personal and professional life are protected, in particular the protection of the parent worker of stillbirth and that of a live birth that dies after childbirth, doing so in opposition to the regimes of other legal systems. In this opportunity, we will try to emphasize the related themes, which have recently been revived, about parental grief and the recognition of grief in involuntary pregnancy loss, always keeping in mind a critical and analytical perspective of the rights currently granted.
