As situações de violação generalizada dos direitos humanos e de perseguição individual e severa consciencializou-nos para a necessidade de garantir às vítimas de tais situações a protecção internacional de que carecem. O essencial de tal protecção consiste na atribuição de um direito de acolhimento; no direito a não ser devolvido ao Estado de origem; e, ainda, na necessidade da disponibilização de garantias procedimentais e judiciais para a sua efectivação. Tal aspiração pode ser concretizada mediante a atribuição a tais indivíduos do Estatuto Internacional de Refugiados. O presente trabalho reflecte sobre o conteúdo daquele direito, salientando-lhe as insuficiências e apresentando as respostas que a União tem criado para realizar este desiderato.
Situations of generalized violation of human rights and individual and severe persecution made us aware of the need to guarantee victims of such situations the international protection they need. The essence of such protection consists in granting a right of reception; the right not to be returned to the State of origin; and, furthermore, the need to provide procedural and judicial guarantees for its implementation. Such an aspiration can be realized by granting such individuals the International Status of Refugees. The present work reflects on the content of this right, highlighting its shortcomings and presenting the answers that the Union has created to fulfill this desideratum.
