Abstract(s)
Ao longo desta dissertação será feita uma análise aos pressupostos do crime de burla romântica, identificando traços comuns nas múltiplas formas de atuação do agente. Partindo do caso de Simon Leviev, também conhecido como o Impostor do Tinder, serão estudados os passos típicos do crime em questão, seguindo-se o respetivo enquadramento jurídico penal na lei portuguesa com recurso à jurisprudência. O crime de burla romântica não constitui um mero crime contra o património, aproximando-se de outros tipos legais devido à forma insidiosa como é perpetrado. A dignidade e a saúde das vítimas deste tipo de crime não são adequadamente protegidas pela lei portuguesa, pelo que serão sugeridas alterações nesse domínio. Considerando o crescimento da cibercriminalidade a nível global, serão feitas considerações a respeito do uso da Internet para cometer ou facilitar determinado tipo de crimes.
Throughout this dissertation, an analysis will be conducted on the assumptions of the crime of romantic fraud, identifying common traits in the various ways the perpetrator acts. Drawing from the case of Simon Leviev, also known as the Tinder Swindler, the typical steps of the crime in question will be studied, followed by its legal and penal framework in the Portuguese law, with reference to jurisprudence. The crime of romantic fraud is not a simple crime against property, approaching other legal types due to the insidious manner in which it is perpetrated. The dignity and health of the victims of this type of crime are not adequately protected by the Portuguese law, so changes in this domain will be suggested. Considering the growth of cybercrime globally, considerations will be made regarding the use of the Internet to commit or facilitate certain types of crimes.
