| dc.description.abstract | O trabalho que nos propomos a realizar baseia-se nas wrongful actions, mais precisamente nas wrongful birth/life actions e no seu impacto na responsabilidade médica civil em Portugal. O interesse por esta temática resulta da multiplicidade de obstáculos jurídicos que estes tipos de ações enfrentam desde a sua génese e ainda pelas desconcertantes conceções morais, éticas e religiosas que as perseguem. Durante o nosso estudo iremos descortinar as principais características deste tipo de ações, seguindo-se uma análise da evolução histórica jurisprudencial, tanto a nível internacional como nacional. No último capítulo iremos enquadrar as wrongful birth/life actions no regime de responsabilidade civil português, identificando os seus pressupostos e tentando encontrar o melhor método indicado a preenchê-los. | pt_PT |
| dc.description.abstract | The study we propose to carry out is based on wrongful actions, more precisely on wrongful birth/life actions and their impact on medical civil liability in Portugal. The interest in this theme comes from the multiplicity of legal obstacles that these types of actions face since their genesis, and from the perplexing moral, ethical and religious conceptions that persecute them. During our study we will reveal the main characteristics of this type of actions, followed by an analysis of the historical evolution of jurisprudence, both internationally and nationally. In the last chapter we will provide a legal framework of wrongful birth/life actions in the portuguese civil liability regime, identifying their requirements, trying to find the best method indicated to fulfill them. | pt_PT |
