| dc.description.abstract | Este trabalho terá como objetivo fornecer uma visão do panorama atual das providências cautelares na arbitragem voluntária em Portugal, provisionando também uma perspetiva histórica do tema e evolutiva que construíram os pilares da legislação em vigor. Assim, iniciar-se-á por um exame geral da competência dos tribunais arbitrais para o decretamento de providências cautelares, questão que historicamente levantou elevada controvérsia dada a falta de potestas dos tribunais arbitrais. Paralelamente, verificar-se-á a forma como os tribunais estaduais e os tribunais arbitrais partilham a competência para a ordenação de medidas cautelares. Será, também, analisado o regime em vigor, com enfoque nas limitações dos tribunais arbitrais ao nível cautelar, dada a sua natureza, e na forma pela qual estas limitações são supridas, de modo a fornecer às partes a melhor tutela jurídica, sendo ou não necessária a intervenção dos tribunais estaduais, que atuam no processo arbitral na sua indispensável função de assistência e colaboração, quer numa fase declarativa. Posteriormente, será estudada a eventual capacidade de os tribunais arbitrais ordenarem providências cautelares cujo decretamento e execução se confundam num só momento, e a relação dessa capacidade com a falta de ius imperii por parte dos tribunais arbitrais. Serão, ainda, abordados outros pontos importantes no regime português que dão resposta a problemas da arbitragem, a saber a delimitação do tipo de competências cautelares determináveis pelo tribunal arbitral e a figura do árbitro de emergência, interveniente na arbitragem voluntária que, ainda que não previsto na LAV, pode ser uma figura central no suprimento de falhas de um tribunal arbitral ao nível cautelar. | por |
| dc.description.abstract | The aim of this work is to provide an overview of the current landscape of injunctions in voluntary arbitration in Portugal, also providing a historical perspective of the subject and the evolution that has led us to the current legislation. It will begin with a general examination of the competence of arbitral tribunals to order interim measures, an issue that has historically been highly controversial given the arbitral courts’ lack of potestas. At the same time, it will be examined how state courts and arbitral tribunals share the power to order precautionary measures. The current regime will also be analyzed, with a focus on the limitations of the arbitral tribunals at the precautionary level, given their nature, and the way in which these limitations are overcome, in order to provide the parties with the best legal protection, whether or not it is necessary to resort to the state courts, which intervene in the arbitration process in their indispensable role of assistance and collaboration. Other important points in the Portuguese regime that respond to arbitration problems will also be studied, such as the delimitation of the type of precautionary powers that can be determined by the arbitral tribunal and the figure of the emergency arbitrator, an intervener in voluntary arbitration who, although not provided for in the LAV, can be a central figure in remedying an arbitral tribunal's shortcomings at the precautionary level. | eng |
