Abstract(s)
O contexto laboral enquanto reflexo de uma sociedade em permanente mutação, encontra desafios constantes. O fenómeno da globalização, enquanto realidade inexorável, encerra o monolitismo de outrora, no seio do qual foram perspetivados os normativos que tutelam a liberdade religiosa e que encontram previsão nos mais variados instrumentos. A questão que se impõe é se o espetro laboral se encontra verdadeiramente dotado para dar resposta a um cenário sociorreligioso.
A presente dissertação visa, precisamente, ilustrar o confronto subjacente à discussão, e refletir sobre o espaço que a liberdade religiosa encontra na relação laboral, sobretudo quando em causa está a utilização de símbolos religiosos. Para o efeito, atentamos nos conceitos que endossam a matéria e nos permitem uma análise com mais clareza do acervo jurisprudencial emanado pelos diversos Tribunais, concluindo com a alusão a outros ordenamentos que evidenciam uma visão verdadeiramente progressista nestas matérias e que em muito enriquecem o nosso estudo.
The labour market, as a reflection of a society in constant mutation, faces constant challenges. The current phenomenon of globalization, as an inexorable reality, ends the impenetrable norm of the past during which the concepts that define religious freedom were established, and which are provided in the most varied instruments. The question that arises is whether the current labor market is truly equipped to respond to a socio-religious scenario. The purpose of this dissertation is to illustrate the point under discussion and to reflect on the place that religious freedom has in the workplace, particularly when it involves the display of religious symbols. Therefore, we shall focus on the concepts that allow contextualization of the matter and allow a clearer analysis of the case law decisions issued by the various Courts. As a conclusion, we will allude to other ordinances that show a truly progressive vision in these matters and that greatly enrich our study.
