Abstract(s)
Ao longo desta Dissertação de Mestrado, a Autora procura ponderar os diversos princípios de Direito Internacional Humanitário em jogo nas regras da precaução na condução das hostilidades (arts. 57º e 58º do PA I) com aqueloutros princípios fundadores dos textos das Convenções de Genebra: a protecção de civis e a preservação da humanidade no conflito. Para tal, começa por referir as noções de distinção e de ataque, bem como o conteúdo geral das normas relativas ao princípio da precaução. Segue-se uma explicação do problema quando confrontado com as circunstâncias específicas que orientam a decisão militar. Por último, aborda-se a questão da utilização de escudos humanos e o modo como essa prática entra em diálogo directo com as regras da precaução. Defende-se a tese de que, dando o devido peso aos interesses militares na equação, nomeadamente a necessidade e a prossecução de vantagem militar pelas partes, não se poderá nunca abdicar do sentido último e mais profundo do DIH: cuidar, na medida do possível, que a população civil não resulte afectada em virtude do desenrolar dos conflitos armados. Esta há-de ser uma preocupação constante na educação para o DIH, principalmente das hierarquias militares.
Throughout this Master’s dissertation, the Author tries to weight the main IHL principles at stake within the rules of precaution in attacks and against its effects (articles 57º and 58º from AP I) with the founding principles of the Geneva Convention’s texts: the protection of civilians and the preservation of humanity in armed conflict. To do so, she starts by stating the concepts of distinction and attack, as well as the normative content of the principle of precautions in attack. Then follows an explanation of the major problems when facing the specifics that guide military decision. At last, addresses the issue of human shields, referring how it directly relates with these precautionary rules. The Author believes that, despise the due importance each military interest must be given, e.g. military necessity and advantage desired, one can never give up on the fundamental goal of IHL: doing all things feasible to assure that civilians and the civilian population will rest safe and spared from the ruses of war. This shall be the major concern ruling the education for IHL, especially when concerning the higher ranks of the military.
