A aprovação da Lei nº 73/2017, de 16 de agosto, implementou, no ordenamento jurídico português, um conjunto de medidas de diversa índole, cujo escopo é o de reforçar a prevenção e o combate ao assédio no trabalho.
Dedica-se o presente trabalho a uma reflexão e análise do novo regime, relativamente ao qual se constata ainda o parco contributo doutrinal e jurisprudencial, no que concerne às matérias que se nos afiguram mais relevantes e estruturantes, bem como as suas debilidades e fragilidades, eventualmente comprometedoras do respetivo sucesso e viabilidade prática.
Com esta dissertação, criticar-se-ão as soluções encontradas, questionando-as e propondo alternativas que, de entre tantas outras, constituirão, assim se defende, contribuições válidas para um mercado de trabalho justo e digno.
The approval of the Law n. 73/2017, of August 16th, introduced in the Portuguese legal system a diverse set of measures, whose scope is to reinforce the prevention and combat of harassment at work. The present work is devoted to a reflection and analysis of the new regime, on which there isn´t, until now, enough legal literature and case-law contribution, regarding these matters that we consider most relevant and structuring, as well as its weaknesses, that may compromise its success and practical implementation. Throughout this thesis, we will criticize and question the solutions implemented by the law, proposing alternatives that, among many others, will consubstantiate, as it is defended, valid contributions for a fair and dignified labour market.
