Em alguns setores ou profissões que funcionam 24 horas por dia, os trabalhadores,
embora fora dos respetivos locais de trabalho, permanecem às ordens do empregador e
disponíveis para a execução do trabalho, caso tal lhes seja solicitado. Este regime de
disponibilidade, também frequentemente designado “tempo de prevenção”, suscita
dúvidas quanto à qualificação e regime aplicável a tais períodos, convocando ainda
reflexão sobre a segurança e saúde destes trabalhadores e, bem assim, quanto à
conciliação da atividade profissional com a vida pessoal familiar, nestas circunstâncias.
In some sectors or professions that operate 24 hours a day, employees, although away from their workplaces, remain at the employer´s command and available to work if requested. This “on stand-by” regime, also often referred to as “on-call time”, raises doubts as to the qualification and regime applicable to such periods, also calling for reflection on the safety and health of these employees, as well as on the conciliation of professional activity with personal and family life under these circumstances.
