| dc.description.abstract | Nesta dissertação, será abordada a questão relativa ao papel dos sujeitos na defesa do Ambiente, proporcionando uma reflexão sobre a importância da informação ambiental e o seu acesso, no contexto atual e de constante evolução em que vivemos. Será evidenciado qual o caminho a trilhar no acesso à informação ambiental, a importância da participação dos sujeitos, as obrigações do Estado perante o Ambiente e, por fim, de modo a encontrar soluções para os problemas suscitados nesta temática, a importância das ONGA na salvaguarda deste bem jurídico e na agilização de todo o procedimento informativo e participativo. Para o efeito, será ainda analisada legislação fundamental neste tema, designadamente, a Convenção de Aarhus, a Lei n.º 26/2016, de 22 de Agosto, a Diretiva 2003/4/CE, do Parlamento Europeu e do Conselho, de 28 de janeiro e a Lei n.º 35/98, de 18 de Julho, que nos irão dar a conhecer os esforços levados a cabo ao longo dos últimos anos na concretização da causa ambiental. | pt_PT |
| dc.description.abstract | On this dissertation we will address the issue related to the role of the subjects in the defense of the Environment, giving insight about the importance of environmental information and its access, in current context and constant evolution that we live in. It will be shown which way to go regarding the access of environmental information, the importance of participation, the obligations of the State towards the Environment and, finally, the importance of the NGOs in the security of this legal asset and in the agility of this informative and participatory process, in order to find solutions to the problems raised in this theme. For this purpose, the legislation on this subject will be analyzed, namely, the Aarhus Convention, Law no. 26/2016, 22 of August, the Directive 2003/4/CE, of the European Parliament and Counsel, 28 of January and Law no. 35/98, 18 of July, that we will make known the efforts carried out over the last few years in the materialization of the environmental cause. | pt_PT |
