O ambiente da economia colaborativa tem fomentado a criação de diversas novas relaçÔes jurĂdicas, com caracterĂsticas inteiramente inovadoras ou semelhantes a transaçÔes jĂĄ existentes e reguladas no mundo jurĂdico. Essas situaçÔes se qualificam principalmente pela troca de bens e serviços entre âparesâ. Muitas dessas novas relaçÔes tĂȘm por base a prestação de serviços que habitam as fronteiras do ordenamento, sem exata proteção dos consumidores ou clientes e dos prestadores. Ao analisar esses serviços e definir as obrigaçÔes das partes, Ă© importante definir qual o nĂvel de diligĂȘncia esperado dos prestadores. O artigo apresenta uma noção de profissionalismo, que servirĂĄ de base para avaliar se Ă© possĂvel exigir uma diligĂȘncia profissional, qualificada e mais elevada que a comum. Em especial, estuda o tratamento do âalojamento localâ no direito portuguĂȘs para examinar se essas atividades da economia colaborativa tendem a se profissionalizar. Por fim, pondera-se qual o padrĂŁo de cuidado a ser exigido.
Many new legal relations were fashioned in the collaborative economy arena. Some of them are characterized by entirely new elements, but some of them are very similar to existing legal transactions and activities that are already regulated. These new situations are qualified mainly for goods and services exchange between âpeersâ. Several of these new affairs are based on services provisions situated in legal grey areas, lacking consumers, clients and providers protection. It is important to outline the standard of care expected from the providers to properly address the issue regarding these services, especially to define partiesâ obligations. The paper drafts a concept of professionalism, to establish a basis for assessing whether it is possible to demand a professional standard of care in a peer-to-peer service, which would be qualified and higher than ordinary diligence. In particular, the homestay services regulation in Portuguese Law is analysed, with the aim to evaluate if these sharing economy activities tend to be professionalized. Lastly, it is considered what is the standard of care to be expected.
