| dc.description.abstract | A génese da economia digital impulsionou o desenvolvimento de novas formas de trabalho, nomeadamente a partir de plataformas digitais. As plataformas digitais de trabalho originaram uma relação por norma triangular, entre plataforma, condutor e cliente. A questão fulcral deste estudo é a de saber qual a natureza da relação contratual entre a plataforma digital e o condutor da mesma. Procurando perceber se os condutores das plataformas digitais de trabalho têm, com estas, um contrato de trabalho ou um contrato de prestação de serviços, fazemos uma análise à presunção do Código do Trabalho e à sua aplicabilidade à relação em estudo, além de oferecermos a nossa opinião sobre qual deve ser a qualificação deste vínculo. Analisamos também as soluções adotadas por ordenamentos jurídicos estrangeiros, nomeadamente Estados Unidos, Espanha e França. Estudamos ainda qual a solução portuguesa atual, bem como a adequabilidade da mesma à relação tipicamente triangular entre plataforma, condutor e cliente. Por fim, apresentamos o nosso entendimento sobre a idoneidade do modelo adotado em Portugal e a nossa apreensão perante a adoção da figura do intermediário entre a plataforma e o condutor. | pt_PT |
| dc.description.abstract | The genesis of the digital economy has driven the development of new forms of work, notably those born from digital platforms. Digital labor platforms have given rise to a typically triangular relationship between platform, driver, and client. The main question of this study is to define the nature of the contractual relationship between the digital platform and its drivers. In an attempt to understand whether the drivers of digital labor platforms have an employment contract or a service agreement contract, we analyze the presumption of the Labor Code and its applicability to the relationship under study and offer our opinion on how this contract should be labelled. We examine the solutions adopted by foreign legal systems, namely the United States, Spain and France. We also study the current Portuguese solution, as well as its suitability to the typically triangular relationship between platform, driver and client. Finally, we present our understanding of the aptness of the model adopted in Portugal and our apprehension regarding the establishment of an intermediary between platform and driver. | pt_PT |
