La protección de las medidad tecnológicas y de la información para la gestión electrónica
de los derechos introducida en el Código do Direito de Autor e Direitos Conexos portugués en 2004, como consecuencia de los Tratados OMPI de 1996 y la transposición de la Directiva 2001/29/CE, es demasiado amplia. Esto permite a los titulares ampliar sus derechos exclusivos de explotación a áreas tradicionalmente libres de derechos de autor y derechos conexos, e incluso la protección de la información organizada por el derecho sui generis del productor de datos, lo que socava el equilibrio entre los titulares de derechos y los usuarios, con graves daños a estos últimos y a la sociedad en general, afectando al desarrollo de la cultura, la educación,
la libertad de expresión y de información. De este modo, se crea una situación paradójica: en la sociedad de la información, en la que la información digitalizada es accesible con un solo clic, el usuario está menos protegido que en la era analógica. La legislación, sin embargo, es sólo el reflejo de lo que ocurre a nivel de la Unión Europea y más allá (por ejemplo, los EEUU) Esto requiere un replanteamiento de todo este asunto a escala internacional.
The protection of technological measures and rights-management information introduced in CDADC, in 2004, due to WIPO 1996 Treaties and the transposition of Directive 2001/29/EC, is overly broad, allowing the holders to extend their exclusive rights of exploitation to areas traditionally free in Copyright and Related Rights, and even the protection of information organized by the sui generis right of data producer, undermining the balance between rights holders and users, with serious damage to the latter and society in general, affecting the development of culture, education, freedom of expression and information, thus creating a paradoxical situation: in the Information Society, in which digitized information is accessible within one click, the user is less protected than in the analog era. The legislation, however, is only the reflection of what is happening at the level of the European Union and beyond (eg, the US) That requires rethinking this whole matter at international scale.
