Abstract(s)
Este trabalho teve como objetivo caracterizar a população inimputável em medida de segurança. Imputabilidade é a capacidade pessoal de um indivíduo compreender e autodeterminar o seu comportamento. Relativamente ao comportamento criminal, a responsabilidade jurídica depende do entendimento do autor do delito acerca do seu ato, dos seus resultados e efeitos (Toledo, 1999). Os dados foram recolhidos através da consulta de 110 processos de indivíduos considerados inimputáveis. Para esse efeito foi utilizada uma grelha que contempla informações sócio demográficas, clínicas, criminais e prisionais do público-alvo. Os resultados revelam que os indivíduos considerados inimputáveis apresentam maioritariamente o diagnóstico de esquizofrenia, sendo também caracterizados por uma maior incidência de crimes de homicídio. A partir dos resultados obtidos são apresentadas propostas de investigação futura no âmbito da inimputabilidade.

In what concerns the criminal behavior, the justice system depends on the level of awareness that each individual has of his act, and its consequences and effects (Toledo, 1999). The data were collected through the consult of 110 processes of individuals considered with criminal nonimputability. For this purpose, in order to gather socio demographic, clinic, criminal and imprisonment information of the target population, a grill was used. The results reveal that the majority of the individuals considered with nonimputability present a diagnosis of schizophrenia as well as a bigger incidence of homicide crimes. Based on these results some searching proposals on the issue of nonimputability are presented for the future.
