Abstract(s)
O presente trabalho tem como ponto de partida a apresentação das linhas gerais da classificação ontológica das constituições, efetuada pela primeira vez por Karl Loewenstein. Realizada, num primeiro momento, a análise de teor descritivo, procurarse-á fazer, em seguida, uma leitura crítica dessa classificação, perspetivando, por isso, pari passu a força normativa da Constituição. Como teremos oportunidade de mostrar, o desafio que se impõe ao constitucionalismo resulta da emergência de novas democracias, cujas necessidades e anseios não têm correspondência no direito constitucional de moldes tradicionais. Daí que o peso do modelo constitucional ocidental deva ser relativizado, se quisermos abarcar outras realidades e espaços geográficos que ultrapassam conceções europeias e aspiram a outras conquistas. Assim, o olhar atento sobre o que se passa no perímetro americano e germânico tem como fito principal repensar a criação de um projeto constitucional em Angola.
This work starts by outlining the ontological classification of constitutions, first presented by Karl Loewenstein. Having done a comprehensive description of the classification, we will proceed with a a critical analysis, trying to pinpoint the normative strength of constitutions. We will have the opportunity to show that the challenge that constitutionalism faces today is mostly due to the appearance of new democracies, whose needs do not have a correspondence in traditional constitutional law. Because of this, we should look to the western constitutional models as having some limitations concerning their application to other cultures and geographical areas, which are beyond western conceptions and are seeking other frontiers. Thus, the focus on the american and german model has its main purpose in rethinking the creation of a new constitutional project in Angola.
