| dc.description.abstract | Com o presente estudo pretendemos proceder a uma análise dos regimes de proteção dos consumidores aos quais sejam fornecidos bens defeituosos, em virtude de um contrato de compra e venda, em especial, na compra e venda de bens móveis. Para tanto, iniciamos o presente estudo com uma breve análise do regime paradigmático do contrato de compra e venda. Em seguida, focamos a nossa atenção na análise do regime da compra e venda de coisas defeituosas consagrado no Código Civil, procurando compreender se e de que modo a conceção adotada responde, atualmente, aos direitos do consumidor, assegura o papel do vendedor e corresponde às exigências que resultam dos princípios gerais de Direito. Posteriormente, indagar-nos-emos acerca do atual regime especial da Compra e Venda de Consumo e as suas especificidades, para que possamos compreender, desde logo, se a recente alteração legislativa se traduz numa mudança positiva, capaz de assegurar a tutela dos sujeitos que compõem a cadeia de consumo (em especial, os direitos do consumidor), bem como, responder aos desafios que se colocam atualmente neste ramo do Direito. Em suma, procuraremos analisar, de forma crítica, de que modo o consumidor se encontra atualmente mais protegido – quer na esteira do Código Civil, quer em face do atual diploma em matéria de Direito do Consumo, o DL 84/2021, de 21 de outubro. | pt_PT |
| dc.description.abstract | This article aims to carry out an analysis of the protection systems of the consumer to whom defective goods are supplied under a purchase contract, especially in the purchase and sale of movable goods. For this purpose, we begin this study with a brief analysis of the paradigmatic regime of the purchase and sale contract. Furthermore, we focus our attention on the analysis of the regime of the purchase and sale of defective things set forth in the Portuguese Civil Code, in an attempt to understand if and how the adopted concept currently responds to the consumer’s rights, assures the seller's role and corresponds to the requirements resulting from the general principles of Law. Subsequently, we inquire the current special regime of consumer buying and selling and its specificities, so that we can understand, from the outset, if the recent legislative change translates into a positive change, capable of ensuring the protection of the subjects that include the consumption subject (in particular, consumer rights), as well as, respond to the challenges that currently arise in Consumer Law. In conclusion, we will try to understand, in a critical way, how the consumer is currently more protected – either in the wake of the Portuguese Civil Code, or in view of the current diploma on Consumer Law - , presenting, finally, what is, in our point of view, the ideal solution. | pt_PT |
