Abstract(s)
A presente dissertação visa analisar em que medida o regime do período
experimental, atualmente previsto no Código do Trabalho, se mostra adequado a
situações em que o exercício da atividade pelo trabalhador ocorre fora do estabelecimento
do empregador, atendendo à distância a que as partes estão sujeitas, num período que se
revela essencial para o destino da relação laboral. Para o efeito, revelou-se essencial o
estudo do fundamento do período experimental, bem como do objeto da experiência,
tendo em conta que, nestes casos, estando as partes distantes, o contacto entre estas se
estabelecerá frequentemente por meios telemáticos. Neste sentido, demonstrar-se-á que,
verificadas determinadas circunstâncias, é necessário um tratamento específico destas
situações em período experimental.
This dissertation aims to analyse to what extent the probationary period regime, established in the Labour Code, is suitable for situations in which the exercise of the activity by the employee takes place outside the employer’s establishment, given the distance to which the parties are subject, in a period that is essential to the future of the employment relationship. For this purpose, it was essential to study the basis of the probationary period, as well as the object of the experiment, considering that, in these cases, the parties are distant and the contact between them will often be established by telematic means. In this sense, it will be demonstrated that, under certain circumstances, it is necessary a specific treatment of these situations during the experimental period.
