A presente dissertação tem como principal objetivo desenvolver o tema da Tutela do Consentimento na Proteção de Dados, com base numa análise ao Regulamento Geral sobre a Proteção de Dados (Regulamento (UE) 2016/679, do Parlamento Europeu e do Conselho, de 27 de abril de 2016). A produção, recolha e armazenamento de dados pessoais devem respeitar as condições e regras presentes no regulamento. Nesse sentido, para haver um tratamento de dados pessoais válido, é necessário o cumprimento dos princípios jurídicos elencados na presente lei e o preenchimento de um conjunto de fundamentos taxativo, dos quais o consentimento. O consentimento é o único fundamento de licitude consagrado na Carta dos Direitos Fundamentais da União Europeia, o que realça a sua relevância jurídica. Contudo, se aquele que se encontra responsável pelo tratamento dos dados não cumprir com o preenchimento dos requisitos legais impostos, incorrerá em responsabilidade civil contratual ou extracontratual, consoante o caso concreto, estando sujeito a pagar uma indemnização ao titular dos dados ilicitamente tratados.
The main objective of this dissertation is to develop the theme of the Protection of Consent in Data Protection based on an analysis of the General Data Protection Regulation (Regulation (EU) 2016/679 of the European Parliament and of the Council of 27th April 2016). The production, collection and storage of data protection must respect the conditions and rules of the current regulation. To have a valid treatment of data protection, it is necessary to comply with the legal principles listed in this law and to complete a set of exhaustive grounds, including consent. Consent is the only legal basis enshrined in the Charter of Fundamental Rights of the European Union, which highlights its legal relevance. However, if the person responsible for processing the data doesn’t comply with the legal requirements imposed, he or she will incur contractual or extra-contractual civil liability, depending on the specific case, being subject to paying a compensation to the holder of the illicitly processing data.
