| dc.description.abstract | No presente estudo, propomos analisar a relevância laboral das relações que se estabelecem entre plataformas digitais e aqueles que, através das mesmas, desenvolvem uma atividade profissional. Para tal afigura-se, desde logo, essencial delimitar os vários elementos que compõem o objeto da presente dissertação, como seja o contexto histórico, social e cultural que presidiu à origem da denominada “Economia de Plataformas”, mas também procurar saber “o que é”, afinal, uma plataforma digital e as principais diferenças entre os modelos organizacionais adotados pelas mesmas. A respeito dos profissionais é dada preferência a uma abordagem “caso a caso” na análise do seu status perante as plataformas, que tenha necessariamente em consideração novas manifestações de subordinação jurídica, reveladas quer pelo exercício dos poderes típicos de direção e controlo por parte das plataformas, quer pelo grau individual de dependência organizativa revelado pelo prestador. Por fim, destacamos o importante papel da Comissão Europeia na harmonização destas questões de forma transversal aos Estados-Membros, mas também relevando o papel do legislador português no contexto da regulação do mercado de trabalho com vista à promoção do trabalho digno, com especial impacto no contexto da “Economia de Plataformas”. | pt_PT |
| dc.description.abstract | In the present study, we propose to analyze the relevance, from a labour standpoint, of the relationships entered between digital platforms and those who render their activity therein. To this end, it is essential to identify the different elements that form the object of the present work, such as the historical, social and cultural context that led to the onset of the so-called “Platform Economy”, but also to understand what a digital platform actually is and the main differences between the organizational models adopted thereof. Regarding the providers, a “case by case” approach is emphasized in the analysis of their status vis-à-vis platforms, which necessarily takes into consideration new manifestations of legal subordination, inherent to the use of the power of direction and control by the platform, but also by the individual degree of organizational dependence revealed by the provider. Finally, we end by highlighting the important role of the European Commission in harmonizing this issue across the Member States, but also the role of the Portuguese legislator in regulating the labour market with a focus on promoting decent work, with special impact in the context of the “Platform Economy”. | pt_PT |
