Este trabalho estuda a participação e audição da criança vítima de crime contra a liberdade e autodeterminação sexual em processo penal. Vê-se a evolução sobre a perceção da criança e a crescente valoração da sua palavra, a nível nacional e internacional. Analisa-se a harmonização da proteção da criança vítima com a estrutura do nosso processo penal e os direitos de defesa do arguido. Refere-se a participação da criança vítima de abuso sexual no processo, em particular a tomada de declarações para memória futura. Descreve-se a prática atual no Porto e apresenta-se uma análise crítica. Conclui-se deixando em aberto alguns tópicos de reflexão acerca desta diligência.
This paper studies the participation and hearing of the child victim of a crime against sexual freedom and self-determination in a criminal procedure. It looks at the evolution of the perception of the child and the increasing consideration of the child’s word. It analyses the harmonization of the child’s protection with the structure of the Portuguese criminal procedure and the defendant’s defence rights. It refers to the participation of the chid victim of a sexual abuse in the procedure, in particular the taking of statements for future memory. It describes the current experience in Porto and presents a critical analysis. It concludes leaving some open topics for consideration about this inquiry.
