| dc.description.abstract | A presente dissertação incide no estudo do Processo Especial de Revitalização, em especial, no regime da proteção do financiamento do devedor, recentemente alterado pela Lei n.º 9/2022, de 11 de janeiro que, entre outras, transpõe a Diretiva (UE) 2019/1023, do Parlamento Europeu e do Conselho, de 20 de junho de 2019. Pretende-se, deste modo, analisar o regime de incentivos à concessão de financiamento, concretamente, os artigos 17.º-H e 120.º, n.º 6, comparando a versão anterior do diploma legal com a recentíssima alteração, aproveitando-se, igualmente, para analisar criticamente as opções do legislador. Através deste trabalho foi possível concluir que a intervenção do legislador nesta matéria de proteção do financiamento do devedor era necessária tendo, contudo, ficado aquém daquilo que se esperava. | pt_PT |
| dc.description.abstract | This dissertation focuses on the study of the Special Revitalization Proceedings, in particular, the regime of the protection of the debtor's financing, recently amended by Law 9/2022, of 11 January which, among others, transposes the Directive (EU) 2019/1023, of the European Parliament and of the Council, of 20 June 2019. In this way, it is intended to analyse the regime for the guarantees of financing, specifically, articles 17.º-H and 120.º, no. 6, comparing the previous version of the legal diploma with the very recent amendment, also taking the opportunity to critically analyse the options of the legislator. Through this work it was possible to conclude that the intervention of the legislator in this area of protection of the debtor's financing was necessary, having, however, fallen short of what was expected. | pt_PT |
