A dissertação de mestrado corrente, centra-se na análise distinta da figura de impugnação pauliana no âmbito do direito civil, e da Resolução em Benefício da Massa insolvente no âmbito do direito das insolvências. É feita a comparação dos dois regimes que visam a garantia de conservação do património. A densificação dos regimes está conseguida através da comparação/diferença destes, bem como da análise de alguns pontos em discussão na jurisprudência portuguesa. Análise dos pontos essenciais do regime através do estudo de direito comparado (Italiano, Espanhol)
The following master’s dissertation is focused on the distinct analysis of the actio pauliana figure – within the scope of the civil law - , and the resolution in behalf of the insolvent estate – within the scope of the insolvency law. Both regimes are compared, aiming to assure the patrimony conservation. The densification of the regimes is accomplished with their comparison/differentiation, as well as with the analysis of some points being discussed by the Portuguese case law.
