Com a diminuição da confiança nos modelos retributivos e reabilitativos do sistema de justiça
criminal, o modelo de justiça restaurativa tem vindo a mostrar-se uma alternativa apelativa (Lee,
2009). O presente estudo visa abordar a justiça restaurativa no sistema tutelar educativo,
procurando conhecer o posicionamento dos profissionais sobre práticas restaurativas e a sua
perspetiva sobre as experiências dos jovens ofensores nestas abordagens. Com o intuito de
responder aos objetivos colocados, procedeu-se à análise do posicionamento de seis (6)
participantes, todos eles profissionais que desenvolvem a sua atividade junto de jovens ofensores.
No final, foi possível constatar que existe alguma indefinição e falta de clareza na definição fornecida
de justiça restaurativa. Apesar de os profissionais considerarem a implementação destas práticas
como sendo uma mais-valia, esta ainda se revela algo prematura em Portugal. Este estudo tem
como contributo elucidar acerca do posicionamento dos profissionais sobre a implementação de
medidas restaurativas e os benefícios associados para os jovens ofensores.
With decreasing confidence in retributive and rehabilitative models of the criminal justice system, restorative justice model has to show an appealing alternative (Lee, 2009). This study aims to address the restorative justice in the educational tutelary system, seeking to know the placement of professionals on restorative practices and their perspective on the experiences of young offenders in these approaches. In order to meet the goals placed, proceeded to the analysis of the positioning of six (6) participants, all professionals who develop their activity with young offenders. Eventually we realize that there is some uncertainty and lack of clarity in the definition provided of restorative justice. Although professionals consider the implementation of these practices as an added value, this still reveals something premature in Portugal. This study was to elucidate contribution about the placement of professionals on the implementation of restorative measures and the associated benefits for young offenders.
