Abstract(s)
Nesta dissertação será abordada a problemática jusfundamental das relações amorosas que ocorram no contexto laboral, tentando compreender como é possível alcançar um equilíbrio entre, por um lado, a proteção dos direitos fundamentais e de personalidade dos trabalhadores e, por outro, a liberdade fundamental da empresa a autorregular-se e a controlar o ambiente e o espaço de trabalho de modo a atingir os resultados económicos propostos. Uma vez que se trata de um tema complexo, não só por se cruzarem diferentes áreas do direito – direito do trabalho e direitos fundamentais – mas também pelo galopante avanço das NTIC, reconhecemos, desde já, a dificuldade em providenciar respostas unívocas a todas as problemáticas suscitadas. Concomitantemente, o tema da dissertação versa também sobre outras áreas científicas, tais como a psicologia e a sociologia, pelo que esta é uma temática que carece de uma visão global interdisciplinar. Assim, iremos dividir nosso estudo nas perspetivas do trabalhador, por um lado, e do empregador, por outro; reconhecendo a problemática como um verdadeiro conflito de direitos. Abordaremos ainda o despedimento por justa causa que, muitas das vezes, se tem traduzido na resposta dada pelas empresas aos relacionamentos íntimos ou amorosos entre os seus trabalhadores. Finalizando a presente dissertação, e porque o direito não é meramente bibliográfico e documental, constará um pequeno estudo prático por nós conduzido, que contou com a participação de 300 pessoas. Neste estudo, procurámos compreender e quantificar as experiências dos inquiridos acerca das relações amorosas no contexto laboral, assim como as suas opiniões sobre a melhor forma de resolução de conflitos que daí advenham.
This dissertation addresses the fundamental issue of romantic relationships in the work context, while trying to understand how it is possible to achieve a balance between, on the one hand, the protection of fundamental and personality rights of workers and, on the other hand, the fundamental freedom of the company to self-regulate and control the environment and the workspace in order to achieve the proposed economic results. We recognize that this is a complex issue, not only because different areas of law intersect – labor law and fundamental rights – but also for the sprinting advance of the new ICT. At the same time, the theme of the dissertation also deals with other scientific areas, such as psychology and sociology, so this is a theme that needs an interdisciplinary global vision. Thus, we will divide our study in the perspective of the worker, on the one hand, and the employer, on the other hand; recognizing the problem as a real conflict between rights. We will also address dismissal, which has often resulted in the response given by companies to intimate or romantic relationships between their workers. Concluding this dissertation, and because law is not merely bibliographic and documentary, we conducted a small practical study, that counted with the participation of 300 people, in which we tried to unveil the experience of the respondents about the problem, as well as their personal beliefs about the best way to resolve it.
