| dc.description.abstract | The problem the present Dissertation focuses on is: “Is the wording of Article 64 of the Portuguese Companies Commercial Code still up to date in light of the CSDDD, as the culmination of CSR tensions?”. To this end, through dogmatic-legal research, we have seen how Corporate Social Responsibility (CSR) summons ideological tensions, both from an economic and law point of view, but with a tangible legislative growth that has brought the figure of the stakeholder into the legal debate. Taking the CSDDD as the culmination of these tensions, we conclude that the Portuguese duty of Loyalty would benefit from a reform adjusted to the reality of large companies that have been experiencing the emergence of this hybrid CSR paradigm. | eng |
| dc.description.abstract | A presente Dissertação procura focar-se na questão jurídica: “Estará a letra da lei do Artigo 64º do Código das Sociedades Comerciais Português ainda atualizada à luz da CSDDD, como culminar das tensões da RSE?”. Para o efeito, através de investigação dogmático-jurídica, verificámos como a Responsabilidade Social das Empresas (RSE) suscita tensões ideológicas, tanto do ponto de vista económico como jurídico, mas com um crescimento legislativo tangível que trouxe a figura da parte interessada para o debate jurídico. Tomando a CSDDD como o culminar dessas tensões, concluímos que o dever de lealdade português beneficiaria de uma reforma ajustada à realidade das grandes empresas que têm vivido o surgimento deste paradigma híbrido de RSE. | por |
