| dc.description.abstract | A dissertação de mestrado que ora se apresenta tem como objetivo a análise do regime jurídico do período experimental, debruçando-se sobre os traços característicos deste instituto que ditam o seu funcionamento e, bem assim, a respetiva forma de aplicação do mesmo. Para o efeito, procede-se a uma exposição do enquadramento legal deste regime, tecendo algumas considerações a propósito da mais recente alteração legislativa a este instituto. Enumera-se ainda algumas das questões que vêm sendo debatidas neste âmbito, nomeadamente a propósito da duração e das faculdades extintivas conferidas às partes. Estas matérias podem propiciar uma utilização contrária aos fins visados na criação deste instituto e, por isso, podem dar origem a situações subsumíveis à figura do abuso de direito | pt_PT |
| dc.description.abstract | The master thesis that is now presented aims at the analysis of the legal regime of the trial period, focusing on the characteristic features of this institute that dictate its functioning, as well as, the respective way of its application. To this end, it is made an exposition of the legal framework of this scheme, weaving some considerations regarding the most recent legislative amendment to this institute. It is also analysed some of the issues being discussed in this context, in particular with regard to the duration and extinguishing powers conferred to the parties. These matters may lead to a use contrary to the purposes pursued in the establishment of this legal institute and, therefore, may give rise to situations which are subsumable to the figure of the abuse of rights. | pt_PT |
