Abstract(s)
A prestação de alimentos é um tema que envolve um grupo muito específico de pessoas, dentro do instituto “família”. Em Portugal, o incumprimento dessa obrigação pode originar um procedimento criminal, previsto no artigo 250.º do Código Penal, o qual é objeto de divergências na doutrina e na jurisprudência. Na presente investigação descrevemos todo o envolvente da prestação alimentícia, bem como identificamos e analisamos as principais discussões que rodeiam o crime de violação de prestação de alimentos.
The maintenance (or alimony) is a topic that involves a very specific group of people within the institute ‘family’. In Portugal, the failure of that obligation, can give rise to the crime of evading maintenance obligation, provided in article 250 of the Penal Code, which leads to legal differences both in the doctrine and in the jurisprudence. In this investigation we analyze this form of crime, as well as we identify the main discussions about it until we reach our own conclusions.
