Este trabalho pretende verificar como a harmonização de legislação na área de fusões e
aquisições estimula o desenvolvimento da economia global. Nas últimas décadas as
concentrações de capital e de produção são as principais prioridades para o desenvolvimento
do sistema económico global. O ambiente de mercado comum de uma grande associação
interestadual regional tal como União Europeia é o principal efeito do processo da integração
económica, em que a regulação legislativa assume o papel do instrumento mais importante que
cria oportunidades jurídicas e as condições necessárias para o entrelaçamento mútuo de capitais
de estados diferentes e o subsequente surgimento das empresas transnacionais nesta base legal.
Face ao aumento da pressão competitiva no mercado global e à necessidade de crescimento
rápido a legislação de muitos países passou para o caminho da liberalização na regulação de
fusões e aquisições, incluindo as leis de concorrência.
This work intends to verify how the harmonization of legislation in the area of mergers and acquisitions stimulates the development of the global economy. In recent decades, the concentrations of capital and production have been the main priorities for the development of the global economic system. The common market environment of a large regional interstate association such as the European Union is the main effect of the economic integration process. Legislative regulation in this market environment assumes the role of the most important instrument that creates legal opportunities and the necessary conditions for the mutual intertwining of capitals of different states and the subsequent emergence of multinational corporations on this legal basis. Faced with increasing competitive pressure in the global market and the need for rapid growth, legislation in many countries has moved towards liberalization in the regulation of mergers and acquisitions, including competition laws.
